These terms govern your use of the Bequestra website and your engagement with our personal document organisation, legacy notes workshop and memory & heirloom archive services. Please read them carefully. By using this website or engaging our services, you agree to these terms.
1. Definitions
- "Bequestra", "we", "us", "our" refers to the company operating under the name Bequestra at 198 Surawong Road, Bang Rak, Bangkok 10500, Thailand.
- "Services" refers to the Records Tidy-Up, Legacy Notes Workshops and Memory & Heirloom Archive services offered by Bequestra.
- "User", "you", "your" refers to any individual accessing this website or engaging our Services.
- "Agreement" refers to these Terms & Conditions together with any written scope document agreed for a specific Service.
- "Content" refers to text, images, documents and other materials on this website.
2. Acceptance of Terms
By accessing this website or engaging our Services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person, you confirm that you have authority to do so.
If you do not agree to these terms, please do not use this website or engage our Services.
3. Service Description
Bequestra provides personal document organisation, educational workshops and family archive services. Our Services are administrative and organisational in nature. We do not provide legal, financial, medical or any other professional advice, and nothing in our Services constitutes such advice.
Services are primarily available to clients in Bangkok, Thailand. Home visits are available within Bangkok. Workshop sessions may be held at a location of your choice or at our office.
Availability is subject to scheduling and capacity. We reserve the right to decline a service engagement where we determine that we are not a suitable fit for the client's needs.
4. User Responsibilities
When using this website or engaging our Services, you agree to:
- Provide accurate information when making enquiries or engaging a Service
- Not use this website for any unlawful or harmful purpose
- Not attempt to interfere with the website's functionality or security
- Ensure that documents and materials provided to us for organisation belong to you or that you have authority to provide them
5. Intellectual Property
All content on this website, including text, layout and design, is the property of Bequestra and is protected under applicable Thai intellectual property law. You may not copy, reproduce or distribute any part of this website without our prior written consent.
Documents, photographs and materials belonging to you that you provide to us for a Service remain your property at all times. We make no claim over any materials you provide.
6. Payment Terms
Service fees are stated in Thai Baht (฿). The applicable fee for your Service will be confirmed in writing before work begins. Payment is due as agreed in the written scope, typically 50% at project commencement and 50% on completion for larger projects, or in full upfront for workshops.
Refunds: If we cancel or are unable to deliver a Service, a full refund of any amounts paid will be provided. If you cancel before work has begun, a full refund is available. If work has commenced, fees for completed work are non-refundable. We will discuss any partial refund on a case-by-case basis.
We do not hold or process payment card details directly. Any online payment is processed by a third-party payment provider operating under their own terms.
7. Service-Specific Terms
Records Tidy-Up and Memory & Heirloom Archive:
- Scope is confirmed in writing before work begins
- Original documents and materials are not altered or marked
- Digital copies are delivered and our copies deleted after project completion
- You must be present or have a representative present during home visits
Legacy Notes Workshops:
- Workshops are educational and informational; no professional advice is provided
- Written workshop materials are provided for personal use only
- Participants must be 18 or over unless accompanied by a responsible adult
8. Disclaimers
Our Services are provided in good faith and with reasonable care. However, we make no warranties regarding specific outcomes. Document organisation, archiving and educational workshops produce results that depend on the materials provided and the client's own preferences.
Nothing in our Services constitutes legal, financial or any other professional advice. If you require such advice, please consult a qualified professional.
9. Limitation of Liability
To the fullest extent permitted under Thai law, Bequestra's liability in connection with any Service is limited to the fees paid for that Service. We are not liable for indirect, consequential or incidental losses arising from the use of our Services or this website.
We are not liable for losses arising from events outside our reasonable control, including natural disasters, civil unrest or third-party infrastructure failure.
10. Indemnification
You agree to indemnify and hold harmless Bequestra, its staff and representatives from any claims, losses or expenses arising from your breach of these terms or your misuse of our Services or this website.
11. Termination
Either party may terminate a Service engagement by providing written notice. In such cases, fees for work completed to that point are payable. Sections 5, 8, 9, 10 and 12 survive any termination of this Agreement.
We reserve the right to suspend or terminate website access in the event of misuse.
12. Governing Law & Dispute Resolution
These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from these terms or our Services shall first be referred to informal negotiation. If unresolved within 30 days, disputes shall be referred to the courts of Bangkok, Thailand.
Consumer rights under applicable Thai consumer protection law are not affected by this clause.
13. General Provisions
These terms, together with any written scope agreement, constitute the entire agreement between you and Bequestra. If any provision is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of that provision. These terms may not be assigned by you without our consent.
14. Changes to These Terms
We may update these terms from time to time. Material changes will be noted by updating the date at the top of this page. Continued use of this website or our Services after an update constitutes acceptance of the revised terms.
